Pakistani prisoners case adjourned to July 21 for final disposal in Supreme Court of India

New Delhi: May 3, 2017. (PCP) A Division Bench of the Supreme Court of India comprising of JJ Mr. A.K.Sikri and Mr. Justice Ashok Bhushan today directed Solicitor General of Union of India, Shri Ranjit Kumar to file the Status Report on the foreign prisoners (mostly from Pakistan & POK) presently detained in the Indian jails. This order was made by the Division Bench of the Supreme Court when the counsel for the Union of India could not satisfy the court on the information sought by the petitioner, Prof.Bhim Singh who is also a Sr. Advocate and argued before the Division Bench urging on the court to ensure that justice is delivered to every person (here foreign prisoners detained in the Indian jails for over a decade). Prof.Bhim Singh made a submission before the court that he filed this writ petition (no.310/2005) challenging detention of Pakistani, POK and other foreign detenus arrested under the orders of the Govt.of J&K. Prof.Bhim Singh submitted before the court that he had raised this issue on the floors of the Legislative Council in 2005 (Bhim Singh was Member of Legislative Council at that time) on the status of foreign prisoners detained by the Govt. of J&K under Public Safety Act. Prof.Bhim Singh submitted that he got reply of the Govt. on the floors of the Legislative Council on the number of foreign prisoners detained in different Indian jails under Public Safety Act. He said that this petition (no.310/2005) was filed by him and he has been pursuing this case till day for 12 years. Prof.Bhim Singh urged the Supreme Court of India to decide this matter in the interest of the fundamental rights enshrined in Article 21 of the Constitution of India as every person, irrespective of his nationality is guaranteed that no person shall be deprived of his life or liberty without the procedure established by law. Prof.Bhim Singh said that command of Article 21 is the soul of fundamental rights enshrined in the Constitution in the Chapter of Fundamental Rights. Prof.Bhim Singh also submitted his (written by Bhim Singh) books to the Hon’ble Judges which he had written after his return from Pakistan in 2012 on the invitation of the Lahore Lawyers’ Congress. Prof.Bhim Singh was presented decoration awards by the Bar Association of Supreme Court in the premises of Lahore High Court. This was done to honour Bhim Singh on his services to fight for human cause in India. On the request of the Union of India and Advocates for the respondents, the hearing in the case was adjourned to July 21, 2017. The Supreme Court directed the respondents, Union of India and the State of J&K to file an up-to-date Status Report. The lawyers who assisted Prof.Bhim Singh included B.S. Billowria, S.K. Bandopadhyay, Vijay Pratap Singh and others.
