Trump’s offer to mediate Indo-China dispute double game & meaningless unless Corona matters settled. By Hem Raj Jain

Prez Trump should know that the present border of India with China has become irrelevant after Coronavirus - pandemic, due to Tibet factor.

Nobody questions the good intentions of President Trump to bring peace and harmony all across the world as President of the USA, the leader of the free world. But the way Trump has been airing his wishes without any political will to back it up, Prez Trump’s such offer of mediation (as he earlier did about the Kashmir dispute too between India and Pakistan) is making the USA a laughingstock across the world which Trump should take care to avoid. Such a non-serious offer of Trump in July 2019 in relation to the Kashmir dispute has already made India bring changes in its Constitution / Laws on and after August 5, 2019 (against the letter and spirit of the ‘ Instrument of Accession’ and which is nothing short of usurpation in legal terms) and which has further aggravated the Indo-Pak problems.
The biggest problem with Trump about these matters is that he dabbles in these matters without trying to understand the root cause of the problems which are given below: -
(1)- As far Kashmir, it is the result of communalism born out of partition of India, on communal lines, in 1947. Without going into details of it (which is dealt in my many previous published articles) it is sufficient to mention that this problem can easily be solved by Trump if the USA asks India: -
(A)- (i)- To work for reversing illegal ‘population transfer’ which is against the mandate of partition of India by repealing ‘Citizen Amendment Act’ of India and to identify ~ 80 million (~ 20 % of their expelled population) mainly Hindus from Pakistan & Bangladesh and to work for giving them dual citizenship (one for India and another for Pakistan or Bangladesh). Also to allow dual citizenship to mainly Muslims from Pakistan and Bangladesh (the displaced due to partition) who want to come to India.
(ii)- This matter of dual citizenship can be resolved soon if Trump asks Pakistan & Bangladesh too to do the same.
(B)- (i)- India to repeal the Article 1 (3) (a) of The Constitution of India and PART II THE STATE (3) of the Constitution of J&K [which illegally show J&K as Indian territory (like any other State of India) and even an integral part of India without any mention of the condition of plebiscite to decide the territory of J&K as per ‘Instrument of Accession’ the IoA]. The relevant part of IoA reads as - “[the question of Accession should be decided in accordance with the wishes of the people of the State, it is my Government's wish that, as soon as law and order have been restored in Kashmir, and her soil cleared of the invader, the question of the State's Accession should be settled by a reference to the people. Yours Sincerely Sd/- Mountbatten of Burma]”.
(ii)- For asking India & Pakistan to facilitate a plebiscite in united J&K under Indian authorities (with UN Observers & international media) at the earliest possible after ensuring in united J&K (including Aksai Chin in second stage) the conditions conducive for carrying out such plebiscite required by IoA.
(iii)- For asking India to repeal all said changes made in its Constitution / Laws on and after August 5, 2020 and release all the people of J&K who have been arrested on political basis [out of legally objectionable (in view of IoA) the apprehension of Indian authorities that they may demand plebiscite or independence of United JK] including those people who have been arrested since August 5, 2019 on political basis.
(iv)- For asking India to ensure the peaceful & just rehabilitation of Kashmiri Pandits in Kashmir.
(2)- (i)- As far India’s dispute with China, Unlike Indo-Pak dispute (which is political) on united-J&K, the Indo-China dispute is legal. Hence the USA should persuade India to request the UN to resolve the Indo-China border dispute by referring it to ‘UN Judicial Commission’ (which China cannot refuse being a permanent member of UN).
(ii)- But this can not be done in present circumstances unless the Coronavirus pandemic and its various fallout & implications are settled. Rather Prez Trump (by offering on May 27 the mediation in the Indo-China border dispute) is taking the people of not only the USA and India (who have suffered maximum due to Corona - pandemic) but also the people of the entire world for granted.
(iii)- Rather Trump should realize that now the border between India and China has no meaning in view the fact that (as mentioned at https://www.pakistanchristianpost.com/opinion-details/3599 ) the political fate of Tibet (a buffer State between India and China) can be rewritten if China does not adopt liberal transparent democracy by abolishing its authoritarian Communist political model which has become threat to the survival of entire mankind (more to India which being a border-sharing neighbor is vulnerable to military / political and other threats from China) as is proved during pandemic of Coronavirus (which as per Trump - Administration was made in Wuhan / China and China didn’t do legally expected , as per international laws & norms, to stop this virus spreading from China to rest of the world).
At the same time India should know that the USA is quite capable of playing the double game of running with the hare and hunting with hounds. The Western capital is hugely invested in China hence the powerful exclusive-private-capitalist class in the West (led by the USA) may not like democracy (which is ultimately advantageous to the working class) in China. This May 27 offer is also a balancing act by Prez Trump between India & China and which makes mockery of not only Quad but also an attempt to give clean chit to China in Corona - pandemic matter.
Therefore Prez Trump should show political integrity and instead of indulging in periodic kite flying of mediations in the disputes of India (with Pakistan and China) should, in the present circumstances, concentrate to settle the matters related to Coronavirus - pandemic otherwise this offer of mediation in Indo-China border dispute will be nothing more than vain fishing in troubled waters by Prez Trump.
