Sheikh Hasina irresponsibly shouldn’t leave Hindus and Awami League members & supporters at the mercy of blood thirsty criminals in Bangladesh. By Hem Raj Jain

India committed blunder by helping Bangladesh Army in removing Sheikh Hasina from Bangladesh (ii)- Sheikh Hasina resigned under pressure from Army by 45 minutes ultimatum hence this resignation is not valid in law (iii)- Sheikh Hasina shouldn’t irresponsibly leave Hindus and Awami League supporters at the mercy of blood thirsty criminals (iv)- Sheikh Hasina can protect Hindus and Awami League  supporters if with Indian consent announces her govt in exile in India and then request government of India (GoI) to provide security forces to maintain law & order in her country to protect these beleaguered victims (v) How can an Army Chief force (by 45 minutes ultimatum) the elected incumbent prime minister to resign and leave the country ? Rather this Army Chief should be Court-marshaled (vi)- If Sheik Hasina establishes her Govt in exile with its office on Indian soil then India shall be under not legal obligation to hand-over her to the present regime of Bangladesh even under any extradition treaty. 

—After Sheikh Hasina quit as Prime Minister and left for India,  the bodies of  leaders of the Awami League and their family members were recovered across violence-hit Bangladesh as reported at https://www.msn.com/en-in/news/India/over-20-bodies-of-sheikh-hasinas-party-leaders-found-in-violence-hit-bangladesh/ar-AA1omJ9q?ocid=BingNewsSerp at the same time anti-Hinduviolence erupted across Bangkadesh as reported at https://timesofindia.indiatimes.com/world/south-asia/bangladesh-protest-anti-hindu-violence-erupts-amid-riots-iskon-kali-temple-vandalised/articleshow/112286645.cms . 

This raises a serious moral & legal question for Sheikh Hasiana. How can she leave Hindus and Awami League supporters at the mercy of blood thirsty criminals (mostly supported by Pakistan backed  militant Jihadi of Jamat-e-Islami who both have been  against the creation of independent Bangladesh in 1971 with the help of military intervention of India )  ?  Instead Sheikh Hasina  should with Indian consent announce her govt in exile in India and then request the government of India (GoI) to provide its security forces to protect these beleaguered victims.  This is perfectly valid as per international law because she resigned under pressure from Army by 45 minutes ultimatum (as mentioned at https://www.msn.com/en-in/news/other/bangladesh-unrest-army-gives-pm-sheikh-hasina-45-minutes-to-resign-sources/ar-AA1offxw?ocid=BingNewsSerp ) hence this resignation is not valid in law and Sheikh Hasina  is still the elected Prime Minister of Bangladesh.

As far as the allegation (including by Western countries, the USA etc as mentioned at https://www.pakistanchristianpost.com/opinion-details/4445  ) that Sheikh Hasina came to power through election which were allegedly not free and fair then it was a matter which should have been taken  by these disgruntled / aggrieved elements to Supreme Court of Bangladesh but the Army has no right in any law to force (by giving 45 minutes ultimatum) the elected Prime Minister to resign instead the army along with paramilitary and police force should have ensured proper law & order in the country against the violence by the criminal minded protesters.  

The security forces could have controlled the violence by protesters not by firing bullets on them but by arresting them and by sending them to prison (may be in open prisons if numbers were more) and they could be arrested when they came out of their houses / residences (by defying curfew or other prohibitory orders) without allowing these protesters to gather in large numbers.  But security forces (including Army) instead of discharging their duty of maintaining law and order in the country preferred to stage a coup by forcing (with 45 minutes ultimatum) the elected prime minister to resign and leave the country. 

Moreover instead of maintaining law & order under section 131 of the Cr.P.C. how can an Army Chief force (by 45 minutes ultimatum) the elected incumbent prime minister to resign and leave the country ? Rather this Army Chief should be punished either by court-martial or by the Supreme Court of Bangladesh. 

Also if Sheikh Hasina establishes her Govt in exile with its office on Indian soil then India shall be under no legal obligation to hand-over her to the present regime of Bangladesh even under any extradition treaty.  

 IT is hoped INdia will rectify its mistake which it committed by helping Bangladesh Army in removing Sheikh Hasina from Bangladesh. 

It is hoped now Sheikh Hasina as legally still the prime minister of Bangladesh would realize her moral & legal responsibility to protect the innocent people of Bangladesh and would with Indian consent  immediately announce her government in exile in India and then would request the government of India (GoI) to provide the help of its security forces in maintaining the law & order in Bangladesh to protect these innocent beleaguered victims in Bangladesh.
