Karachi: The Sindh High Court at Karachi here on Tuesday, 28th March 2006, ordered impleadment of The Church Properties Bachao Tehrik, as a necessary party to the dispute over the ownership and illegal sale of St. Andrew`s Church, Karachi. The Honorable Justice Nadeem Azher Saddiqui on an application filed by the Tehrik, through its National Coordinator, Bishop Ijaz Inayat Masih, in a Civil Suit No. 778/2004, made the orders. The Suit was pending adjudication between Rev. Sadiq Daniel, Mr. Sardar Saddique Khan, Attorneys of the Church of Scotland Trust in Pakistan, Lahore Church Council and Government of Sindh, regarding the dispute over the ownership and illegal sale of the said property to Mr. Sardar Saddique Khan by the Attorneys of the Church of Scotland Trust in Pakistan. The Church Property Bachao Tehrik through Mr. Raja Qureshi, Advocate requested the Court on behalf of the members of the Church of Pakistan that the impugned property belongs to the Church of Pakistan and the Honorable Courts vide their earlier orders have already banned the sale of Church properties; he added that vide an order dated 13.02.1999 the Honorable on the request of Bishop Ijaz Inayat Masih was pleased to order that no third party beneficial interest would be created by anybody in respect of Church properties and in order to save the communal property of St. Andrew`s Church, Karachi impleadment of the Applicant is necessary and in the interest of the beneficiaries of the said communal property. The Honorable Court after hearing the Counsels, on Tuesday ordered that since the Applicant seems to be a proper and necessary party to the dispute and it would be in the interest of justice to implead him as a party, an amended title of the Suit be filed within a week and ordered the Applicant to file Written Statement till next date of hearing i.e. 02.05.2006.
