Sindh High Court issue stay order against Bishop Malik and others.

Sukkur: The Sindh High Court Bench at Sukkur here on Wednesday 05, April restrained Bishop Alexander John Malik, Rev. Rafique Masih and others from illegally interfering in the affairs of St. Savior`s High School & College Sukkur and dispossessing its Principal Mrs. Noreen A. Mirza from her peaceful possession. The orders were announced by the Divisional Bench of the Sindh High Court, comprising Mr. Justice Sarmad Jalal Osmany and Mr. Justice Syed Zawwar Hussain Jaffery, in a Constitutional Petition No. D - 236/2006, filed by the Principal of St. Savior`s High School & College Sukkur against Bishop Alexander John Malik, Rev. Rafique Masih, District Coordination Officer Sukkur, Town Police Officer Sukkur and others. The Petitioner Mrs. Noreen A. Mirza through Mr. Bajhan Das Tejawani, Advocate pleaded that the aforesaid educational institution belongs to the Church of Pakistan and lying within the territorial jurisdiction of its Hyderabad Diocese and earlier in a dispute regarding the managing affairs of the above said institution the Sindh High Court Bench at Sukkur as also the Honorable Supreme Court of Pakistan vide orders dated 25.09.2003 and 19.08.2004 respectively ordered that the dispute related to the above said institution should be resolved through the elders of the Church of Pakistan. Whereas Bishop Alexander John Malik of `The Church of Pakistan Lahore Diocesan Council` and his appointee the so-called bishop of Hyderabad Rev. Rafique Masih are illegally portraying themselves as the elders of the Church of Pakistan, in order to affect the managing affairs of the above said institution and illegally dispossessing the Petitioner from her peaceful possession. Mr. Bajhan Das Tejawani, Advocate submitted that Bishop Alexander John Malik has separated from the Church of Pakistan and established an independent and parallel Church, under the name and style of `The Church of Pakistan Lahore Diocesan Council`, therefore he ceases to be a member of the Church of Pakistan and cannot be the Moderator of the Church of Pakistan and for this reason his illegitimate and unconstitutional claims of being Bishop and Moderator of the Church of Pakistan are challenged and pending decision before the Honorable High Court of Sindh at Karachi and Honorable Lahore High Court, wherein-which the Honorable Sindh High Court has ordered him to maintain status quo, while the so-called bishop Rev. Rafique Masih has been illegally appointed as the Bishop of Hyderabad Diocese by Bishop Alexander John Malik, after his alienation from the Church of Pakistan, when Rev. Rafique Masih had exceeded the age of 60 years and was inherently disqualified to contest the election of a Bishop in the Church of Pakistan. Consequently, the disputed positions of Bishop Alexander John Malik and Rev. Rafique Masih are challenged and pending decision before the Honorable Courts and restraining orders passed therein are still operative. Mr. Tejawani pleaded that Bishop Alexander John Malik and Rev. Rafique Masih have joined hands with the aforesaid governmental officials and primed a forged letter of some Arbitration Council appointed by Bishop Alexander John Malik, in order to forcibly dispossess the Petitioner, without any lawful authority and their entire illegal practice amounts to Contempt of Court, hence urgent orders are required to be passed to restrain the illegal and unlawful practice of Respondents. The Divisional Bench after hearing the Learned Counsel for Petitioner restrained Bishop Alexander John Malik, Rev. Rafique Masih and other governmental officials from illegally interfering in the affairs of St. Savior`s High School & College Sukkur and disturbing peaceful possession of the Petitioner.
