Lahore: December 11, 2016. (PCP) An Adventist accused of blasphemy Sajjad Masih Gill was arrested on December 28, 2011, in FIR no 820/12 offence u/s 295 C PPC, PS city Gojra District Toba Tek singh. Trial of this case was started in 2012 in the court of additional Sessions Judge Gojra in District Jail of Toba Tek singh.
On 13 July 2013, learned judge punished Sajjad Masih life imprisonment and two lacs rupees fine. Ch. Javed Sahotra attorney of Sajjad Masih in Trail court was confident that Prosecution has failed to prove his case but Learned Judge due to pressure of fanatic people punished innocent Adventist young man Sajjad Masih.
Adventist attorney human rights activists and member national Minority rights network Javed Sahotra had filed an appeal in Lahore high court on 9 September 2013 against judgement of ASJ Gojra.
In 2015 an application for suspension of sentence and bail was filed on behalf of Sajjad Masih which was sent to the bench of Justice Sardar shamim khan in Lahore high court Lahore .for 8 times this application was fixed in the court of Sardar Shamim khan Justice Lahore high court but case was adjourned again and again because Lordship Sardar Shamim did not want to hear this blasphemy case on pressure of Muslim extremists.
In this way case was unheard and innocent Sajjad has been in jail since 28 December 2011. On 24-9-2016 an application u/s 561-A crpc for early hearing of suspension and bail was filed in Lahore high court on behalf of Sajjad Masih through counsel Javed Sahotra which was sent to hon,ble bench of Justice Aalia neelum. This bench heard early hearing application on 28 Oct 2016 and allowed and was directed to office of high court for fixation of suspension application on 9 Dec 2016.attorney and family of Sajjad Masih were very happy that day of release of Sajjad has come.
On 9 December Attorney Javed sahotra and family of Sajjad Masih left Pakpattan for Lahore at 4 am to argue the case.
Lordship Justice Aalia neelum reached at 10 am in the court and started hearing, Javed sahotra told Lordship Judge that in section 426 crpc two years have been given to hear the appeal of convicted accused and if appeal is not heard within two years after filing of appeal against conviction then conviction is suspended and accused releases on bail. In our case 3 years and 3 months have passed but appeal was not heard and there is no evidence against Sajjad Masih from Tariq saleem complainant of this case because in his statement Tariq saleem got recorded that he had not seen sajjad Masih to committing offence of blasphemy nor any body saw him to committing this offence.
Lordship Judge heard two grounds of application and announced "I refuse to hear blasphemy case because today this came to my knowledge that this is blasphemy case and this will be heard by other bench". This was shock for attorney and family of Sajjad.
The Government of Nawaz league has failed to provide security to judges and Lawyers .it is failure of government of N league that Judges of high court due to lack of security and threats from fanatic religious group are refusing to hear the blasphemy case of Innocent Adventist member of SDA church. Christian community demanded to government to provide security to Judge and attorney Javed Sahotra.
