Karachi: June 26, 2017. (PCP) The Pakistani High Court of Sindh Province vide order dated 22nd June 2017 has directed the newly elected General Secretary of the National Synod of the Church of Pakistan (United) Mr. Anthony Ejaz Lamuel to produce before the Court Proceedings and Minutes of the 15th Triennial Session, on next date fixed by the Court for further hearing of the case.
The directions were issued by the Honorable High Court of Sindh in a law Suit filed by the members of National Synod namely Revd. Parvez Barkat, Revd. Raymond Sohail and Mr. Victor Dass, challenging the legitimacy of the 15th Triennial Ordinary Session of the National Synod allegedly conducted in violation of the provisions of the Constitution of the Church of Pakistan, in which New Officers of the National Synod had been elected last month. During the hearing of the case, the learned Counsel for the Plaintiffs challenged that the Moderator, Deputy Moderator, General Secretary and Coordinator of the National Synod have been elected in violation to the procedure prescribed in the Constitution of the Church.
On 16th and 17th May 2017, the 15th Triennial Session of National Synod of the Church of Pakistan (United) had been conducted at Lahore under the Chair of outgoing Moderator of the Church Bishop Samuel Azariah, who is also retiring this year from the position of Bishop of Raiwind in order to assume his responsibilities in the Episcopal Church at the United States of America.
Besides making an Amendments into the retiring age of the present Bishops of the Church of Pakistan, by way of which two years extension period has been granted by the National Synod (meaning thereby that the present Bishops will now retire from the offices of Bishops on attaining age of 70 years instead of 68 years), while New Officers of the National Synod had also been elected for a term of next three years. Bishop of Peshawar Humphrey Peters has been elected as Moderator of the National Synod, while Bishop of Faisalabad John Samuel has been elected as Deputy Moderator and Mr. Anthony Ejaz Lamuel belonging to Lahore Diocese has been elected as General Secretary of the National Synod for the term of three years.
It has been contended by the Plaintiffs before the Court that the newly elected Officers of the Synod have been elected in violation of the Constitution and Law and hence prayed the Court to summon the Proceedings and Minutes of the Impugned Session.
After initial hearing of the Honorable High Court of Sindh on 22nd June 2017 has passed orders to issue notices to the Defendants, which includes all the Bishops and newly elected Officers of the National Synod to appear before the Court on 5th July 2017, on which date the newly elected General Secretary of the National Synod has been directed by the Court to produce the Proceedings and Minutes of the 15th Triennial Session of the Synod before the Honorable Court.
