Faisalabad: July 14, 2017. (PCP) Professor Anjum James Paul Chairman of Pakistan Minorities Teachers Association PMTA in a letter to Justice Mian Saqib Nisar Chief Justice of Supreme Court of Pakistan have appealed to take Suo-Moto notice against Federal government of Pakistan and Provincial governments on contempt of court on not implementing decision of SCP dated June 19, 2014 in case Regarding Protection of Minorities to allocate 5% quota of jobs in every government department jobs.

Subject: REQUEST FOR SUO MOTO AGAINST THE FEDERAL AND PROVINCIAL GOVERNMENTS AS THEY ARE CONVICTED OF CONTEMPT OF COURT ON THEIR FAILURE IN THE IMPLEMENTATION OF 5 % QUOTA FOR MINORITIES FOR EMPLOYMENT IN THE LIGHT OF 19 JUNE 2014 VERDICT OF SUPREME COURT OF PAKISTAN REGARDING PROTECTION OF MINORITIES RIGHTS
Honourable Sir,
Greetings and peace from Pakistan Minorities Teachers’ Association (PMTA)
PMTA would like to draw your kind attention on the subject cited above.
Sir, the following articles of the Constitution of Pakistan 1973 guarantee;
Article 14 (1) “The dignity of man and, subject to law, the privacy of home, shall be inviolable.”
Article 25 (1) “All citizens are equal before law and are entitled to equal protection of law.”
Article 27 (1) “No citizen otherwise qualified for appointment in the service of Pakistan shall be discriminated against in respect of any such appointment on the ground only of race religion, caste, sex, residence or place of birth”
Article 36 “The State shall safeguard the legitimate rights and interests of minorities, including their due representation in the Federal and Provincial services.”
Sir, Government of Pakistan, Established Division issued notification dated May 26th 2009. The said notification states that the federal government would reserve a 5 % for the employment of minorities as defined in Article 260 (3) (b) of the constitution of Pakistan. It is a state of sorrow that the federal and provincial governments of Pakistan have failed to implement the said notification with letter and spirit which is violation of the June 19, 2014 Verdict of Supreme Court of Pakistan regarding protection of minorities rights.
The federal and provincial governments dehumanize non-Muslims with biased mind-sets and discriminatory policies regarding jobs though it is claimed that Pakistani non-Muslims are enjoying equal rights without any discrimination but there are unconstitutional, illegal, unethical and shameful terms and conditions in the jobs as if they are born as sewage and untouchables and non-Muslims are best suited for the jobs of sewer men/sanitary workers.
Sir, Pakistani Federal and provincial governments are only committed to provide 100 per cent jobs of sewer men/sanitary workers to religious minorities violating recruitment policy in which they have only 5 % due share but they are not ready to give jobs other fields. Question arises, who will be sewer men/sanitary workers in the near future if there are no more non-Muslims because only the population of non-Muslims is decreasing rapidly in Pakistan. The population of religious minorities has been decreased from 23 per cent to less than 5 per cent from 1947 to 2017.
Irfan Masih, a 28 years old Christian sewer man just lost his life being a victim of faith on June 1, 2017 in Umerkot (Sindh). Government doctor refused to treat him in the filthy clothes as he was fasting. The doctor was arrested but later released and according to the latest reports the hospital authority has been declared innocent claiming that Irfan Masih had lost breath when he was brought in the hospital.
Some examples are presented below which show that 100 % jobs of sewer men/ sanitary workers/ sweepers are reserved for non-Muslims (Christians and Hindus) violating article 14, 25, 27 and 36 of the Constitution of Pakistan 1973.
1. Hyderabad Municipal Corporation (Sindh)
Hyderabad Municipal Corporation has announced an advertisement on May 24, 2017 to recruit 450 non-Muslim male sanitary workers on contract basis of 11 months under Reference No-1 Government Sindh Office Order No. SO-III (LG)/14117/2016, dated May 3, 2017. There was a shameful and discriminatory form as well in which they were to take oath as that I….son of……swear of my religion’s Geeta/Bible that I shall perform my duty honestly as sanitary worker.
Pakistan Minorities Teachers’ Association brought the unconstitutional matter and demanded for the immediate corrigendum to the Municipal Commissioner Metropolitan Corporation Hyderabad Ref.No.PMTA/35-36/17-KPR, dated: May 29, 2017. A delegation of PMTA also met on May 30, 2017 for corrigendum. There was promise for corrigendum but has not been published. Though there is only amendment of deleting Geeta/Bible on the proforma of oath. (Copy of advertisement and oath attached).
2. FAISALABAD WASTE MANAGEMENT COMPANY (Punjab)
Faisalabad Waste Management Company (FWMC) announced advertisement in the “Daily Aman Faisalabad” on January 24, 2017 to recruit 337 non-Muslims waste workers on daily wages. When the matter came in the notice of Pakistan Minorities Teachers’ Association then the matter was brought in the notice of the concerned quarters telephonically and a letter Ref.No.PMTA/9-11/17-KPR, dated: January 27, 2017 was sent to the Chairman for corrigendum. There was corrigendum in the advertisement next day and word “non-Muslims” was removed.

3. Tehsil Municipal Officer, Tehsil Municipal Administration Bannu (KPK)
14 posts of sweepers belonging to Shia, Hindu, Balmiki and Christians were announced in the “Daily Aaj” Peshawar on March 19, 2017 but after the protest of Shia there was corrigendum on March 21, 2017 in which word “Shia” was excluded with an apology and unconditional forgiveness. 4. Tehsil Headquarter Hospital Khar Bajore (FATA)
There was an advertisement in the “Daily Aaj” on April 21, 2017 for the recruitment of sweepers. According to the advertisement there were three conditions and the first one was “Only the application of non-Muslims be accepted”. (Copy of advertisement attached).
Two examples are presented below which show that 5 % jobs for minorities has been totally ignored in the federal and provincial government.
1. 1250 posts announced by National Bank of Pakistan
i. Trainee Officers (OG-II) (300 positions- Pan Pakistan)
ii. General Banking Officers (OG-III) (300 positions- Pan Pakistan)
iii. Cash/Banking Officers (OG-III) (500 positions- Pan Pakistan)
iv. Agriculture Field Officers (AFOs) (OG-III) (150 positions)

2. Children Hospital & Institute of Child Health Multan
Children Hospital & Institute of Child Health Multan has announced in an advertisement in the “Daily Express Tribune” Lahore on May 11, 2017 mentioning the following posts of Medical Officers and Women Medical Officers
i. Medical Officers 31 posts
ii. Women Medical Officers 83 posts

Sir, Pakistan Minorities Teachers’ Association requests you for suo moto to address the economic assassination of religious minorities so that they may also lead their lives with dignity as majority in the society without any bias and discrimination on the basis of religion and there could be even Chief Justice of Supreme Court of Pakistan in the shape of late Justice Alvin Robert Cornelius, Chief Justice of Supreme Court of Pakistan.
