Violation of Article 25 of the constitution of Pakistan. By Professor Anjum James Paul

I am trying to highlight a very important issue as there is violation of fundamental rights of the religious minorities in Pakistan which have been described in the constitution of Pakistan 1973. In this column only Article 25 which is about the equality of citizens will be discussed briefly,
25. Equality of citizens.
(1) All citizens are equal before law and are entitled to equal protection of law.
(2) There shall be no discrimination on the basis of sex
(3) Nothing in this Article shall prevent the State from making any special provision for the protection of women and children.
The Father of the nation the Quaid-i- Azam Muhammad Ali Jinnah while presenting his vision in the First Constituent Assembly of Pakistan on August 11, 1947 said “You are free; you are free to go to your temples, you are free to go to your mosques or to any other place or worship in this State of Pakistan. You may belong to any religion or caste or creed that has nothing to do with the business of the State………Now I think we should keep that in front of us as our ideal and you will find that in course of time Hindus would cease to be Hindus and Muslims would cease to be Muslims, not in the religious sense, because that is the personal faith of each individual, but in the political sense as citizens of the State. “
It is a state of sorrow that even the parliamentarians from the minorities have not seriously raised their voice on this important issue. They are either ignorant or deliberately keep quiet. The Federal Ministry of Human Rights and the Federal Ministry of National Harmony shall have to play their role to abolish such discrimination so that the culture of social harmony be promoted in Pakistan. This can only be possible if only the verdicts of the following oaths are amended in the proposed 21st amendment in the constitution of Pakistan. Except the oath of the President the following sentence, “That I will strive to preserve the Islamic Ideology which is the basis for the creation of Pakistan” has been included in all the 15 oaths whether an individual is a Muslim or belongs to minority community except the oath of the Prime Minister which is totally the negation of the beliefs of the minority individuals. Pakistani minorities demand the government of Pakistan not only to frame separate oaths for the minority individuals for which they have to take oath but also to abolish all discriminatory articles from the constitution and discriminatory laws from the Pakistan Penal Code so that there may be proper implementation of the Article 25 of the Constitution of Pakistan. Thus Pakistan will be in the list of moderate and true democratic states. The verdicts of the oaths of the following offices have been presented here. Minorities are also demanding for the change in the electoral system and they are demanding for the right of the dual vote. There was a national seminar in this regard on July 25, 2012 organized by the Federal Ministry of National Harmony. We expect that the representatives of the Election Commission of Pakistan who were present there will show the true picture of the demands and there will not only be increase of seats in the national and provincial assemblies but women from the minorities will be elected along with the Muslim women so that the minority women be also empowered like the Muslim women.

That I will bear true faith and allegiance to Pakistan:
That, as President of Pakistan, I will discharge my duties, and perform my functions, honestly, to the best of my ability, faithfully in accordance with the Constitution of the Islamic Republic of Pakistan and the law, and always in the interest of the sovereignty, integrity, solidarity, well- being and prosperity of Pakistan:
That I will not allow my personal interest to influence my official conduct or my official decisions:
That I will preserve, protect and defend the Constitution of the Islamic Republic of Pakistan:
That, in all circumstances, I will do right to all manner of people, according to law, without fear or favor, affection or ill- will:
And that I will not directly or indirectly communicate or reveal to any person any matter which shall be brought under my consideration or shall become known to me as President of Pakistan, except as may be required for the due discharge of my duties as President.

Prime Minister
[Article 91(5)]

(In the name of Allah, the most Beneficent, the most Merciful.)
