National Conference (NC) President Dr. Farooq Abdullah from J&K addressing various public meetings on Sunday in Lucknow (the capital of largest State in Hindi heartland, the Uttar Pradesh), said that "communal forces (another name for ruling party at centre and in many States, the BJP led by PM Modi) are again raking up poignant and sensitive issues to garner support and polarize the electorate in the forthcoming parliamentary elections in early 2019. Though people in J&K are suffering for the last about three decades due to terrorism and response of Government of India to it in the valley but now it has started pinching the Kashmiris more because earlier majority of the terrorists were from out of J&K (militant Jihadis sent by Pakistan) but now majority of terrorists (so-called freedom fighters) are from Kashmir. That is why now Kashmiris (mostly under influence of separatists) have started blaming Abdullahs (Farooq Abdullah and his son Umar Abdullah both former Chief Minister of J&K, Ministers in Government of India and Member of Parliament) for their sufferings because they said that it was Late Mr. Sheikh Abdullah who was in the forefront for bringing J&K with India during India's partition in 1947.
Farooq should know that his father preferred India for Muslim majority J&K over Muslim Pakistan mainly due to secularism and socialism (mixed economy) though India has not been able to protect and promote both. The record of NC also has been unsavory in this regard. Hence if Farooq is really interest in secularism then he should do the following:-
(1)-First of all instead of castigating BJP on communalism Farooq should make the NC a national secular, socialist, federal party For secularism the NC should file following writ petition in Supreme Court of India (SCI) about :-
(i)- (Even before any judgment in title suit pending with SCI), legally expected restoration of Status-quo-ante of Babri Masjid which was demolished in 1992 in the presence of Observer of SCI also with a prayer that SCI should direct Government of India (GOI) to be ready to requisition UNPKF in case Hindutva communal forces create law & order problem all across the country (if security forces of India can go in other countries for maintaining peace though UNPKF then security forces of other countries can also come in India for maintaining peace through UNPKF).
(ii)- Getting entire process of discriminatory NRC in Assam dropped / quashed under Article 13 & 14 of the Constitution because (A)- NRC is made only for Assam (and not for entire India) which harasses mostly so-called infiltrators in Assam but not so, for so-called infiltrators in rest of India.(B)- NRC is made under unconstitutional Assam Accord 1985 (which discriminately grants citizenship rights to illegal migrants up
to 1971 in only Assam and not in other State). Hence the constitutional validity of Assam Accord has been challenged in SCI therefore before deciding this issue it is unconstitutional on the part of SCI to ask for the preparation of NRC in Assam (because if Assam Accord is struck down by SCI then NRC will become illegal and meaningless).( C)- NRC is being made with religious discrimination because millions Hindus are illegal immigrants in all over India from Bangladesh and Pakistan but India is harassing mostly Muslim illegal immigrants in Assam [Government of India (out of communal discrimination, has already initiated to bring 'Citizenship Amendment Act' through Parliament where except Muslims all others, the Hindus, will be granted citizenship who came illegally from Pakistan, Bangladesh etc]
(iii)- For abolishing (because discriminatory against Muslims etc and favoring Hinduism in a secular India) all the laws related to cow protection, beef eating etc which are causing lynching of Muslims and 'Dalits' in India.
(iv)- Quashing of discriminatory (especially against Muslims) Reservation Policy which, in the name of backward castes, is giving reservations to also those castes of Hindus which once ruled in India.
(v)- Regarding Delhi 1984 & Gujarat 2002 riots the NC should demand responsibility of and punishment to executive magistrates and armed forces who failed in stopping riots under sections 129, 130, 131 Cr.P.C.
(2)- For making the NC acceptable to overwhelming majority of the people of India, the NC should do / demand the following: -
(i)- For socialism (where sovereign / State-capital like private-capital will also be deployed PROFITABLY) the NC should carry our demonstrations at district and State head-quarters all over India (which will bring members in huge numbers to the NC) for demanding recovery of Rs ~ 1,000 Lakh Crore of sovereign State-capital from Income-Tax from about ~ one million tax-evaders (discussed in Parliament also in 2016 as mentioned at https://timesofindia.indiatimes.com/business/india-business/Prominent-people-hiding-taxable-income-Jaitley/articleshow/51408323.cms ) so that not only the tears from the face of every suffering Indian (including suicide-pron farming sector) can be wiped-out by properly & profitably deploying this huge State-capital but also India can be made world class super-power, militarily and economically
(ii)- For Federalism the NC should demand that all civilian subjects (including natural resources) should be with States and only martial subjects like defense, foreign affairs, currency, communication, national transports etc should be with union of India. Even railways should be National and State.
(iii)- Dispute with Pakistan is political but dispute with China is legal which can easily be resolved peacefully. Hence the NC should demand that India should asks UN to resolve it through 'Judicial Commission' in which member nominated by India, China and some other countries can be there.
(iv)- The NC should be truly secular and should not think that how Muslim Kashmiris can think of Hindu majority India taking PoK militarily from Muslim Pakistan. Hence the NC should demand that India should retrieve PoK, the integral part of India as per Constitution and unanimous resolution of Parliament, without any further delay (even militarily if necessarily if Pakistan does not give PoK on table). Because otherwise it is giving legal advantage to Pakistan due to adverse possession (as Pakistan much smaller than India tried, even militarily, to snatch Kashmir (rest of J&K) many times but India not even once. Also the NC should stop saying that 'war is no solution to Kashmir solution because of the destruction it will bring on both side'. The NC should leave it on world-community (which will see to it that how to avoid all-out war between two nuclear countries India and Pakistan and NC should not forget that the last word on India's partition is yet to be written). Rather the NC should first think about bringing relief to the people of J&K who have suffered immensely due to gory & chronic Kashmir problem which can be solved only by unification of J&K which is possible only when India retrieves PoK.
(v)- If justice is not delivered at moderate cost & promptly by Courts then rule-of-law has no meaning. Hence the NC should work for and demand that High Courts under Article 227 of the Constitution should check every file which comes to it from subordinate Courts (District and Lower Courts in appeal, revision writ etc whether presiding officer has granted adjournments unnecessarily) with commensurate punishment to erring presiding officers of subordinate Courts. Moreover along with full-fledged legal library government lodging and boarding facilities at nominal charge should be provided at all the seats of appellate Courts (under supervision of Bar Council of States and of India) for advocates coming from lower Courts so that cases in appellate Courts can be contested at much lesser cost.
(vi)- The NC should file writ petition in SCI to enforce Constitutional obligation regarding public debt against security of consolidated funds under Article 292 & 293 and not under FRBM which has unconstitutionally promoted unethical unbridled usury (interest earning) and has increased public debt unconstitutionally.
(vii)- The NC should work for rehabilitation of hundreds of thousands of displaced Kashmiri Pandits (KPs) even by providing NC volunteers as companions (if necessary) with them in Kashmir (till KPs feel secure in Kashmir)
(viii)- The NC should demand that while keeping English as second language the Hindi (with Devnagri script) should be made working language (including in allopathic medicine, engineering etc) in Hindi speaking and Devnagri variant script States (which comprises overwhelming majority of Indians) because no country can progress without working in its mother tongue. Regarding other (non-Hindi & non-Devnagri variant script) States of India it can be left to them to decide this matter.
It is hoped that if not for the people of J&K and rest of India (at-least for the sake of his father Late Mr Sheikh Abdullah & his colleagues), Farooq Abdullah will make his party National Conference a truly national party supporting secularism, socialism, federalism and rule-of-law in India as mentioned above.
