If PTI heeds the call of Governor Punjab for protecting constitution than bringing Imran back to power as PM, democracy will win in Pakistan. By Hem Raj Jain

Without political parties taking the responsibility of running the country as per laws & constitution, no democracy can function satisfactorily in the contemporary human-rights friendly world.
People all over the world have a very wrong notion about democracy where they think that people run democracy. Of-course democracy is meant for the people but the people on their own can’t run the democracy therefore political parties are needed in every democracy to run the democratic system. But unless political parties in any democracy take interest and are even prepared to struggle / fight for the rights of the people and for the protection of the laws & constitution of the country (which are legislated for the benefit of the people) no democracy can function satisfactorily. But in democratic countries political parties don’t function in such an expected way as is evident from the case of the most powerful democracy the USA & the largest democracy India too.
In the case of India, all of its economic problems can be solved if the Government of India (GoI) recovers about Rs. 1,000 Trillion income tax (about 45 % of over 2,200 Lakh crore) from about one million fake farmers (as mentioned at http://www.newsnation.in/article/121125-news-nation-disclosure-on-blackmoney-kharabpati-farmers-take-agriculture-route-t.html and https://timesofindia.indiatimes.com/business/india-business/Prominent-people-hiding-taxable-income-Jaitley/articleshow/51408323.cms ) . But the GoI is not doing it and no political party in India is coming on streets to constrain the GoI to recover this huge-State capital. Similarly de-jure secularism of India has been destroyed by de-facto communalism of India in case of Babri-masjid episode where Supreme Court of India (SCI) didn’t restore legally expected (because otherwise it is criminal contempt for lowering the authority of the court) the status-quo-ante of Babri-masjid (which was demolished in 1992 in presence of observer of the SCI) before taking any civil proceeding further in Subordinate Court or High Court or Supreme Court. But the Indian judiciary destroyed the authority of the Court (of the SCI) and rule-of-law in India and the SCI also went forward to award so-called final judgment in November 2019 but no political party opposed it effectively and still are not opposing it effectively.
In the case of the USA Prez Biden has come to White House through legitimate elections but Republicans (GoP) under the leadership of former Prez Trump thinks (which they still keep on repeating time & again) that elections were rigged hence Trump lost the Presidential election. It is not important whether these elections were rigged or not. What is important is that if GoP (which traditionally, like Democrats, represents almost half of the USA in elections) thinks that these elections were rigged then they shouldn’t allow Prez Biden to remain in White House and instead should come on streets peacefully all over the USA to get re-election through ballot paper in person and counting without machines. But the GoP carried out ONLY ONE protest (worth the name) rather an attack on January 6, 2021 at Capitol Hill and now the GoP thinks that its responsibilities about protecting rule of law in the USA are over (that too in the matter of the protection of political rights of the people regarding crucial Presidential elections).
Similarly a constitutional crisis has taken place in nuclear Pakistan of about 220 million people where Punjab Governor Omar Sarfraz Cheema as reported at https://www.dawn.com/news/1688100/punjab-governor-says-will-send-reference-against-lhc-judge-for-decision-on-hamzas-oath-by-na-speaker - is sending a reference against Lahore High Court's (LHC) Justice Jawad Hassan to the Supreme Judicial Council (SJC) for an illegal decision of directing the National Assembly speaker to administer oath to Chief Minister-elect Hamza Shehbaz. This has made mockery of democracy in Pakistan as given below:-
(1)- The Shehbaz - government is not only legal but legitimate too. Because even if there was alleged US-conspiracy to dislodge Imran-govt it was a matter between US-govt & Pakistan-govt (the then Imran-govt) and Member of Parliament (MNAs) had nothing to do with it. Hence no-confidence motion brought by MNAs was legal & legitimate unless these MNAs committed some crime which had a potential of disqualifying them. The Imran-govt (during about relevant two months when it was in power) never provided any actionable proof of any money trail etc between USA and these MNAs, therefore the govt of PM Shehbaz Sharif (after no-confidence against Imran-govt without vote of defectors from PTI, the political party, Tehreek-e-Insaf headed by Imran) is a legal & legitimate government.
(2)- But this is not the case with the Punjab government which may be legal (due to court order) but is illegitimate. There is a principle of jurisprudence that ‘no one should be allowed to take benefit & advantage of his or her wrongs’. The Punjab incumbent CM Hamza got a majority with 197 votes with the support of 26 defectors from PTI and they are liable to be disqualified. Hence the majority support base of Hamza is illegitimate in the eyes of the people.
(3)- The said reference to SJC by Governor Cheema is not that explosive as his tweet message to Army Chief General Bajwa where Governor Cheema said that if Gen Bajwa provided him with one subedar and four jawans (later modified as one captain and a platoon of Jawans), he would arrest the ‘illegal, unconstitutional and counterfeit, recently sworn-in Chief Minister Hamza’ (son of PM Shehbaz), and would throw him in jail. This ugly constitutional crisis has arisen in Pakistan because the Supreme Court of Pakistan (SCP) is not taking cognizance of and is not deciding the issue of defection of 26 PTI Members of Legislative Assembly (MLAs) of Punjab (on who’s support Hamza secured 197 votes to become CM) and which is the cause of this constitutional crisis. At the same time no political party (even the PTI) is coming on street to resolve this constitutional crisis in Pakistan
(4)- What is surprising is that the people have not understood the meaning of two statements of the Governor Cheema (while clarifying why he asked the Army Chief to provide army to arrest CM Hamza) that - (i)- I would have appealed to the PUBLIC if I wasn't the Governor and (ii)- the Punjab province, which was facing a constitutional and legal crisis, had been taken hostage by force (during Shehbaz government) and termed the political parties' silence about it, very concerning.
(5)- The people and especially the PTI have not realized that it is an open invitation by Governor Cheema (of PTI before he became Governor and who still is being backed-up by and supporting the PTI) to the PTI that (in case Gen Bajwa doesn’t provide army to Governor Cheema to arrest CM Hamza) then the PTI should come on streets to carry out two tasks by coming on street peacefully - (i)- for arresting Hamza and (ii)- for restoring the government of former CM Usman Buzdar of PTI (who’s resignation has already been declared by Governor Cheema as invalid because it was neither in Buzdar’s handwriting nor was it addressed to Governor).
(6)- The PTI has so far not heeded to the call of Governor Cheema because it is less interested in protecting the laws & constitution of Pakistan and more interested in bringing Imran Khan back to power as Prime Minister (which will also benefit many PTI office bearers and members).
The moment the PTI decides to heed the call of Governor Cheema for achieving two S.No. 5 mentioned objectives in the interest of protecting the laws & constitution of Pakistan, the democracy would win in Pakistan (more than in the USA & India as explained above).
